Both the offer and acceptance are based on these terms and conditions. We will issue you with an invoice number after we have received your offer to purchase. If you have questions or concerns, discuss with us prior to the final ordering / invoicing process being completed.

Please always check details carefully when ordering. This includes notes for availability of a product on the detail pages. Some products advertised in our online store are pending in-store or supplier availability, whilst we endeavor to keep the stock levels as accurate as possible, and keep as many items in stock as possible, we cannot always guarantee availability at all times as we sell through various channels. Products not currently in stock need to be ordered in from our suppliers (pending availability at the time of ordering). This can take 1-90 business days from date of order.

If for any reason we cannot process, accept, or fulfil your order after payment is received, we will contact you by email or telephone in a timely manner to determine your requirements for the reimbursement of money paid. At this time, we may offer or update an ETA for the products ordered if the product is already in transit from the vendor. At no time will VANEM be held liable for loss of business or costs under any circumstances due to products being out of stock, delayed, unavailable, sold out, discontinued or cancelled at the time of ordering for any reason.

Discount pricing. From time to time we will have sales or offer reduced prices for clearance items or end of line items. This may be for over stocked, discontinued items or simply because we have a sale. Any returns made for sale items are pending acceptance of the return. We recommend checking our returns policy for details about returns of sale, discounted, discontinued, bargain items. VANEM will not be held liable for any additional taxes or duties applied to export orders in your country. We cannot estimate or predict taxes in your country prior to the shipment being dispatched due to complex tax and import laws in various countries. Please check your local laws and regulations regarding importations prior to ordering if you have concerns.

Any order that is returned to VANEM due to unpaid taxes or duties will be the purchaser’s sole responsibility. We may decide to reject returned parcel that have brokerage payments due. If accepted on your instruction, we will only resend the parcel after delivery charges and administration fees are paid prior to re sending, this would include any incidental charges we occur regarding the return of your order if you failed to pay taxes and duties or take receipt of your order. If the shipment is in dispute and cannot be resent, a min 20% restocking fee will apply as well as all fees and related charges associated with the consignment’s delivery to the purchaser.

VANEM retains all evidence and documentation of delivery charges and associated costs, if in dispute these will be provided.

SHIPPING & DELIVERY POLICY:

VANEM ships goods Australia wide and to other countries either from Australia or direct from Japan. If your order, or part thereof, cannot be shipped you will be notified promptly. Items purchased are generally shipped from our stock located in Artarmon, New South Wales Australia or direct from Japan (known as Japan direct ship or Drop ship). Our delivery partner within Australia and for export orders dispatched from Australia is Australia Post. Unless you are notified otherwise this is the method we will use - (dependent on items being purchased and size / weight of the order).

If your order is dispatched direct from Japan, we will determine the best method to dispatch your goods. This may include delivery via EMS (Japan Post) or shipment via DHL, UPS, Yamato, or FedEx courier. For larger sea freight consignments, details will be discussed at time of ordering or prior to packing.

*We do not accept requests for private couriers or customer’s preferred couriers for pickups under any circumstances.

Orders for all products in stock are generally dispatched within two business days (24-48 hours) where possible, our business hours are 9 to 4pm (Monday to Friday), this quoted time is from the time that a payment has been received in full. Exceptions to this may include but not be limited to orders placed on the weekends or Friday. Orders placed late Friday or on a weekend will still require adequate time for payments to clear and freight to be arranged. Delivery time is estimated to be between 2-10 business days or as notified at time of ordering. Extended lead times may apply due to your location, size of the order and packaging requirements etc. or delays in the postal / freight system that are out of our control. Any delays caused due to delivery issues will not be a reason to cancel or refund an order under any circumstance. VANEM will not be liable for loss of business due to delays of any kind.

Signature on delivery: All parcels will need to be signed for upon delivery. Under no circumstances will parcels be delivered without a signature on delivery from the receiver or without proof of dispatch unless notified otherwise. We also highly recommend extra cover (or insurance) where available to cover your purchase. *During COVID restrictions, there may now be circumstance where parcels being delivered may not require a signature due to social distancing reasons. These details can be found on the Australia Post website or as advised at time of ordering (where possible).

If you are not available when our delivery partner attempts a delivery, a card may be left advising you that your order will be available for you to collect from your local post office or depot. If no such arrangements can be made, we, or our delivery partner, will attempt to contact you to arrange an alternative delivery time. Any goods returned to VANEM as “undeliverable”, will only be returned to you after appropriate handling and delivery charges are paid.

SHIPPING RATES AND RESTRICATIONS:

Shipping and handling rates are calculated based upon your location and the size / weight of your order. Upon completion of your order the shipping cost will be displayed on your invoice and or quote. At times, goods that require special packing procedures, or are heavy and bulky items, may incur additional packing or freight charges to cover packaging and or our time to process. This may also be applicable to export orders that require special handling.

Some items are hazardous and shipping restrictions apply (for both Australian and International Orders). Should a shipping restriction apply, we will contact you to discuss how to handle your order. Alternatively, please contact our sales department, during business hours (weekdays), to discuss any such restriction or concerns

VANEM will not falsify any shipping documents or invoice documentation to facilitate shipment of hazardous goods. Also, we will not falsify, write down or alter pricing on tax invoices for international (or local) orders to avoid or lessen applicable taxes and or duties.

Drop Shipping: VANEM will not process or dispatch orders via “drop ship” to third parties under any circumstances unless discussed and arranged in full prior to ordering. In the rare case we accept an order in this fashion, the purchaser (you) will be liable in full for all shipping liabilities. In the instance a drop ship is sent outside of Australia (from Australia or Direct ship from Japan), the receiver of the goods is responsible for all delivery issues including but not limited to taxes and or duties applied at time of delivery to the end user (customer) if so applicable. In the case of any dispute, you the purchaser will be responsible to facilitate all resolutions. At all times we will of course help resolve any issues with shipping to the full extent that is possible and or reasonable.

SHORT DELIVERIES:

If you believe your order / consignment is short (missing products) at time of delivery, we the supplier (VANEM) must be advised within 2 business days of you receiving the goods. Any claims after this time may be dismissed if not disclosed in a prompt manner. In the case of parcel delivered damaged and missing products, it is the purchaser’s responsibility to notify the delivery services of the problem at the time of delivery.

Whilst we (VANEM) will make every reasonable effort to rectify the issue, you understand and agree in advance that it may require time to investigate and check our stock to determine if you believe the order is short. At all times we work from a packing list that is verified and doubled checked prior to shipping all goods. Orders may also be photographed at time of packing and date stamped for our records and reference prior to the order being sealed.

WARRANTY POLICY:

In the exceedingly rare case that you find a manufacturing fault when you receive your parts or products, please contact us prior to returning the item. Most products sold by VANEM will carry a 12-month warranty to the original purchaser of the product where they meet the conditions stipulated in our warranty policy. Please ask at the time of ordering for specific details about warranties as some parts are excluded from manufacturer's warranties. You can also check the warranty tab found at each products details page within the website. However, it is not written or implied that all parts carry warranty and we "VANEM" will not be liable for any costs beyond the products purchase price. This may include but not be limited to break downs, repairs by third parties, towing, loss of income or any other associated costs. The parts that carry warranties are warranted by the manufacturers so any replacement and or repair is generally at their discretion. VANEM will do everything possible to have an item considered for warranty, where appropriate, and will handle all dealings on your behalf. Any item that is found to be faulty must be returned to us to verify the issue before it will be processed for warranty. We may ask you for photographic proof prior to returning and to help speed up any warranty claim. If the product is found to have a manufacturing fault, we will return all costs incurred for the postage and replace the part as needed in a timely manner once granted by the manufacturer or as ruled by VANEM and once the originally purchased items has been returned for verification. We (VANEM) at our discretion will decide to 1, replace, 2, refund or 3, repair the product after verification of a fault.

VANEM will accept product returns for warranty and provide you with a refund, exchange, or repair where:

1)      The product is clearly faulty or is not of acceptable quality; or

2)      The product is not fit for its intended purpose; and

3)      You can present your original sales receipt or other adequate proof of purchase.

VANEM has clear warranty terms and conditions. Before a warranty claim is considered, please see our full warranty policy, or contact us to discuss the process for obtaining warranty. In short, all goods returned for warranty must be returned to us (VANEM) for inspection and testing. Goods must only be returned for warranty with a warranty claim number and VANEM warranty form filled out in full. Goods showing signs of misuse, neglect or alteration may be void of warranty. All goods not installed by qualified licensed professionals may also be void of warranty. Goods used for race or closed-circuit use will not be covered under any circumstances.

Certain items will come with a VANEM serial number or decal to identify the parts origin, in the case goods are missing identifiers or you cannot be verified as the original purchaser of the goods, warranty may be void.

PRODUCTS USED FOR RACING: All warranties will be void for parts that are used for racing use, off-road or if the parts are installed on bikes other than the listed models in which they are intended.

SUITABILITY: Parts fit only applications listed with each item so if in doubt ask prior to purchase. We are not responsible for incorrect fitment if your bike is a mix of old and new model parts (e.g.: If you quote your bike is a 78 model and it is running 2005 import parts then that is your responsibility to know what bike you have and request parts correctly in the first instance) any result of incorrectly ordered and fitted parts in such a situation will be the owner’s responsibility. Parts that have been modified, altered, or changed in any way from how they were sold will also not be considered for warranty.

ELECTRICAL PARTS: Generally electrical parts are not returnable unless there is a clear fault on receipt of the part at the time of delivery (prior to fitment). If you are unsure about suitability of the part you wish to purchase, please ask us prior to sale and we can confirm the suitability and compatibility of the item for your application. Parts listed will work on models listed only. These parts rely on correct fitment by professional and experienced people. Electrical goods can be damaged by existing faults that have not been fixed prior to fitting. Please do your diagnostic work prior to fitting new parts not with the new parts - (Parts can be easily ruined by neglecting to fix faults).

EXHAUST SYSTEMS: Warranties do not cover damage caused by crashes, modification, exposure to corrosives such as cleaning products or deterioration caused by exposure to the elements or wear. The owner is responsible for all damage caused by poor installation, off-road use, accidents, use on race days and track days, neglect or when engines are incorrectly tuned. Warrantee is not available for bluing of chromed systems or for discoloring of stainless systems. It is a normal process that will happen with use. Manufacturer's warranties will apply when applicable to manufacturing faults. Exhaust warranty returns must have approval prior to return and have all hardware and documentation returned when making any claim. In general DAYTONA & POSH exhaust systems we offer will be covered by a 12-month warranty for normal private use.

NOTE: Incorrectly tuned engines that are causing excessive running temperatures and engines that have excessive vibration issues may void exhaust warranties. This is also applicable to systems fitted in an alternative manner to the recommended guides (e.g.: failing to use the correct exhaust hanger or dampers). Some exhausts rely on the engines being correctly tuned to make the most out of the new system. Taking measures to service and check the tune of your engine after modifications will ensure correct use and longevity of the product purchased. We highly recommend the state of tune be checked by a professional tuner when fitting any new exhaust system. This is to help avoid possible damage to your engine and new exhaust which can result by neglecting to have the carburetor settings adjusted. Always check and make needed adjustments when fitting exhausts and air filters. Use a reputable technician and have your engine dyno tuned when making modifications if possible, failing to do so can be costly and void warranty. If making a claim for an exhaust system we will ask for these tuning details, and the details of your service work that was done when fitting the new system.

WEAR AND TEAR ITEMS: We do not warrant (nor does the manufacturer) parts such as cables, bulbs, filters, brake component such as pads and rotors, engine and gear box components and rubber items. SR400/500 models and other bikes that are modified can have excessive vibration known to cause faults with frames, headlights and brackets, indicators, mirrors etc. when the engine is poorly tuned. Owners have a responsibility for these problems. For example, if you have removed the indicator mounting rubbers and fit indictors to a solid mount, excessive vibration may cause faults, this may also occur with mirrors and any other component that can be harmed by excessive vibrations due to poorly maintained or modified bikes / engines or off-road use. To the same extend use of products on the racetrack under harsh conditions will cause excessive wear. Please do your research prior to modifications being made and ensure correct fitment of parts is carried out in a safe and lawful manner. Failing to do so will result in warranties being void if proof of correct work cannot be verified.

ALLOY TANKS: All tanks should have extra care taken to avoid any rubbing, chaffing and wear by piping, frames and or harnesses which may cause faults. Tanks should always be mounted correctly on the rubber mountings as fitted to the bike when it left the factory or as supplied by the manufacturer of the tank. Making corrections and modifications by removal of such parts is at the owner’s own risk. Faults caused by excessive vibrations due to poorly maintained bikes and or poor fitment is also the owners responsibility. Any tanks incorrectly fitted will not be considered for warranty. Please check your tank for fitment and that the tank is not being damaged in anyway. We advise to do this on a regular basis to avoid any faults. Warranties will also be void for damaged caused by crashes, modification, exposure to corrosives such as cleaning products or deterioration caused by the elements or wear. The owner is responsible for all damage caused by poor installation, off road use, use on race days and track days. Please use care when maintaining your alloy tank to prolong its life. Also note, removal or smoothing down of welds may cause leaks and or premature fault to alloy tanks. Under no circumstances should you alter the weld or construction of the tank. VANEM will not be held liable for any costs associated with leaks or fault on tanks that have been painted. It is the customers responsibility to check the tank for faults prior to painting.

INCORRECTLY FITTED & NEGLEGTED PRODUCTS: or products where service intervals have not been adhered to and or cannot be shown to have been completed will not be considered for warranty. The correct operation of parts depends on installation procedures and maintenance schedules being followed. If the parts are not fitted by an experienced licensed technician and proof of installation or regular service intervals is not available, warranty may be void. Please care for your parts to maintain their longevity and to keep your bike and yourself safe!

The correct operation of parts always depends on installation procedures being followed so do it right the first time and enjoy years of safe riding, always do regular maintenance, and check safe operation on a regular basis!
